Introduction

Scenic respects the intellectual property (“IP”) rights of others and expects all users of our Service to do the same. This Intellectual Property Policy (“Policy”) explains how Hangzhou Jingzang Network Technology Co., Ltd.,  杭州景藏网络科技有限公司, or Scenic, herein referred to as: ("Company", "we", "our" or "us") addresses allegations of IP infringement, how users may report such concerns, and how Scenic responds in compliance with applicable laws and industry standards.

Scope of the Policy

This Policy applies to all user-submitted content on Scenic, including but not limited to:

- Routes and Waymarks
- Photos, videos, audio, text descriptions, and combinations thereof
- Echos (short-form posts)
- Posts
- Comments, captions, and other written submissions

By using Scenic, you agree not to post any content that infringes the intellectual property rights of others.

Ownership of Content

- Your Content: You retain ownership of any original content you upload to Scenic, subject to Scenic’s Terms of Use which grant us a license to host, display, and distribute your content within our platform.

- Scenic Content: Scenic’s brand assets, software, design, and proprietary technologies are owned by Scenic and protected under copyright, trademark, and other IP laws. Unauthorised use of Scenic’s IP is strictly prohibited.

Prohibited Use of Intellectual Property

You may not upload, share, or otherwise use content that:
- Copies or reproduces copyrighted works without authorisation.
- Does not have explicit publishing permissions from the copyright holder.
- Is distorted or altered in an effort to make unique. Such content still belongs to the copyright holder.
- Uses third-party trademarks in a misleading or unauthorised way.
- Uses similar or confusingly similar trademarks without permission.
- Contains pirated media, plagiarised material, or stolen assets.
- Attempts to re-distribute Scenic’s proprietary content (including maps, data layers, and route analytics) without permission.
- Constitutes acts that infringe on intellectual property rights.

Reporting Intellectual Property Infringement

If you believe your IP rights have been infringed on Scenic, you may submit a Notice of Infringement to Scenic’s Designated Agent at:

Your Notice must include:
1. Identification of the copyrighted or trademarked work claimed to have been infringed.
2. Identification of the infringing material (with URL or in-app link).
3. Your contact information (name, address, email, phone).
4. A statement that you have a good faith belief that the use is unauthorised.
5. A statement, under penalty of perjury, that the information is accurate and you are the rights holder or authorised to act on their behalf.
6. Your physical or electronic signature.

Scenic's Response to Notices

- Upon receiving a valid Notice, Scenic will promptly remove or disable access to the allegedly infringing material.
- The user who posted the material will be notified and given the opportunity to submit a Counter-Notice if they believe the removal was in error.
- Repeat infringers may face account suspension or permanent termination.

Submitting a Counter-Notice

If you believe your content was removed in error, you may submit a Counter-Notice to Scenic’s Designated Agent, including:
- Identification of the removed content and its location.
- A statement under penalty of perjury that the content was removed in error or misidentification.
- Your consent to the jurisdiction of courts in your country / region.
- Your physical or electronic signature.

Scenic may restore the content if the original claimant does not file legal action within the timeframe required by law.

Repeat Infringers

Scenic enforces a three-strike policy: users who repeatedly infringe IP rights will face account restrictions, suspension, or termination. Severe or intentional infringements may result in immediate removal without prior strikes. Find out more in our Repeat Infringer Policy below.

Repeat Infringer Policy

Scenic respects the intellectual property rights of creators, users, and rights holders, and expects the same from all users of our Services. In accordance with applicable intellectual property laws and best practices, Scenic has adopted the following Repeat Infringer Policy.

Definition of Repeat Infringer
A Repeat Infringer is any user who, after receiving proper notice, has had their content removed or access disabled multiple times due to valid intellectual property complaints, or who otherwise demonstrates a pattern of infringing activity on Scenic.

While Scenic reserves the right to determine what constitutes “repeat” infringement in our sole discretion, this may include (but is not limited to):
- Two (2) or more valid copyright, trademark, or other intellectual property complaints consecutively or cumulatively within one year;
- Repeated re-uploading of content previously removed for infringement;
- Attempts to circumvent Scenic’s content removal systems.

Consequences for Repeat Infringers
Scenic may take one or more of the following actions against Repeat Infringers:
- Removal of infringing content;Limiting visibility of future content;
- Suspension of account features, including the ability to upload or share routes, photos, videos, or Echos;
- Temporary or permanent account termination;
- Restriction from re-registering for Scenic under the same or different identity.

Escalation Process
Before any permanent action is taken, Scenic will generally:
1. Issue Warnings: Users may receive written warnings after confirmed valid IP complaints.
2. Notify Users: Each time content is removed for infringement, users will receive a notification describing the complaint and providing information about filing a Counter-Notice if they believe it was removed in error.
3. Review Pattern: Scenic will track notices received against a user’s account to determine if they meet the criteria for repeat infringement.

Exceptions and Considerations
Scenic may, at its discretion, take into account mitigating factors such as:
- Whether the user promptly removed or corrected the infringing content;
- Whether a Counter-Notice was filed and the result of that process;
- Whether the infringement was minor, incidental, or unintentional.

Reservation of Rights
Scenic reserves the right to immediately suspend or terminate any account for a single case of serious infringement (e.g., large-scale piracy, intentional misappropriation, or repeated violations across multiple accounts).

Scenic's Role and Limitations

- Scenic does not mediate IP disputes between users but will enforce this Policy based on valid notices and applicable law.
- Scenic is committed to acting in accordance with safe harbour principles under laws such as the DMCA (where applicable) and international equivalents.

Updates to This Policy

Scenic may update this Policy from time to time to reflect changes in laws, technology, or industry standards. Users will be notified of significant changes via in-app notifications or email, along with updating the “Last Updated” date at the top of the new Intellectual Privacy Policy.
